Terms of Use

1. Acceptance

By using onthespotdating.com (the “Site”) or The Spot iOS application (the “App”, together with the Site the “Service”), you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by Summit Capital LLC (“we”, “us”).

2. Eligibility

The Service is intended for adults 18 or older. By signing up to the waitlist or creating an account in the App you confirm you meet this minimum age. We reserve the right to require identity verification and to suspend or delete any account we believe is operated by a minor.

3. Your account

You agree to provide accurate information when creating your account, to keep your sign-in credentials secure, and to be responsible for all activity that happens under your account. You may only operate one account.

We may suspend or terminate your account at any time for violations of these Terms, for safety reasons, or as required by law.

4. How The Spot works

The Spot is an in-person-first dating app. There is no in-app messaging. After you match with another user, the only ways to interact are:

• Seeing each other’s “going out tonight” status if either of you posts one.
• Sending a time-limited location pin (an “invite”) that expires after 30 minutes.

Free accounts may send one invite per night. Paid plans allow more. Whether to walk up and introduce yourself when you receive an invite is entirely up to you.

5. Acceptable use

You agree not to:

• Impersonate another person, use someone else’s photos, or otherwise misrepresent who you are.
• Harass, threaten, stalk, or harm any other user.
• Upload sexually explicit, violent, hateful, illegal, or otherwise inappropriate content.
• Use the Service for commercial solicitation, escorting, prostitution, or any other illegal purpose.
• Attempt to access, probe, scrape, or interfere with the Service or its backend.
• Use automated tools, bots, or scripts to interact with the Service.
• Reverse engineer, decompile, or attempt to extract source code from the App.
• Submit emails or accounts that do not belong to you.
• Sell, transfer, or share your account.

We may remove content or suspend accounts that violate these rules. Severe or repeated violations result in permanent bans.

6. Real-world safety

The Spot facilitates real-world meetings. We perform identity verification to reduce the risk of fake profiles, but we cannot guarantee anyone’s identity, intentions, or behavior. You are solely responsible for your conduct and safety when meeting another user in person.

Always meet in a public place. Tell a friend where you’re going. If you feel unsafe, leave and contact local emergency services.

7. Reports and blocking

You can report any user from their profile (top-right menu → Report) and block any user (top-right menu → Block). Blocking removes both users from each other’s Discover feed and unmatches you if you are matched. Our team reviews reports for violations of these Terms.

8. Content you upload

You keep ownership of the photos, prompts, and other content you upload. By uploading you grant us a worldwide, non-exclusive, royalty-free licence to host, store, and display that content for the sole purpose of operating the Service (showing your profile to potential matches).

You represent that you have the right to upload the content, and that it does not violate anyone’s rights or any law.

9. Subscriptions and billing

Paid plans (Basic and Pro) are billed through the Apple App Store. Prices and renewal periods are shown in the App at the time of purchase. Subscriptions renew automatically each period unless cancelled at least 24 hours before the current period ends.

You can manage and cancel subscriptions in iPhone Settings → Apple ID → Subscriptions. We do not control Apple’s billing or refund policy.

10. Termination

You can delete your account at any time. We can suspend or terminate your access for any violation of these Terms or for any reason that protects the safety of our users. On termination, the data-handling rules in our Privacy Policy apply.

11. Intellectual property

The Spot name, logo, copy, design, App, and Site are property of Summit Capital LLC. You may not reproduce or distribute them without written permission.

12. Disclaimer

The Service is provided “as is”, without warranty of any kind, express or implied. To the maximum extent permitted by law, Summit Capital LLC disclaims all warranties including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the maximum extent permitted by law, Summit Capital LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service, including damages resulting from interactions with other users.

14. Indemnification

You agree to indemnify and hold Summit Capital LLC harmless from any claim arising out of your use of the Service, your content, or your violation of these Terms.

15. Changes

We may update these Terms over time. Material changes will be announced in-app or by email. Continued use of the Service after a change means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Nevada, USA, without regard to conflict-of-law principles. Any dispute is subject to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada.
